Terms of Service

1. About these terms

These Terms of Service form an agreement between you and The Better Growth Company Ltd, a company registered in England and Wales (company number 12585000), trading as Fat Genie and operating CareerCaptain. By creating or using a CareerCaptain account, you agree to these terms.

Nothing in these terms affects statutory rights that cannot lawfully be excluded or restricted.

2. The service

CareerCaptain is a career-memory and career-support service. It lets you keep useful details about work, study, projects, learning, people and other career activity; add photos and files; bring in LinkedIn history for review; see your history over time; make CVs and profiles; download your information; share selected work; prepare for meetings; get writing help; review a week; and work through career decisions.

Features may change as the product develops. We will not deliberately make a material contractual change retroactive where doing so would be unfair to consumers.

3. Your account

You are responsible for providing accurate account information, keeping your credentials secure and notifying us if you believe your account has been compromised. You must not access another person's account without authority.

CareerCaptain is currently intended for people aged 18 or over. An institution must not invite an under-18 learner unless CareerCaptain expressly provides a separately reviewed under-18 route with the safeguards and information appropriate to that use.

4. Your content and other people's information

You retain responsibility for the information you add to CareerCaptain. You grant us the limited rights needed to host, process, back up, transform and transmit that information solely to operate, secure and improve the service and to provide features you request.

If you record information about another person, you are responsible for having a lawful and fair basis to do so and for avoiding unnecessary sensitive, confidential or unlawful material.

If you create a share link, you are responsible for deciding what it contains, who receives it and whether a password or expiry is appropriate. A link that always shows the latest version can change when you change the underlying information. A saved-version link continues to show that saved version until the link expires or is turned off. Turning off a link cannot retract copies a recipient may already have saved or downloaded.

5. Generated help

Generated work can be incomplete, incorrect or based on missing information. CareerCaptain is designed to keep its suggestions separate from the information you originally added, but you remain responsible for reviewing anything important before relying on it.

Information showing what CareerCaptain used is there to help you review the result, not to guarantee accuracy. If you later add what happened, CareerCaptain treats that as your own report, not as independent proof that its earlier suggestion caused the outcome.

CareerCaptain supports your judgement; it does not use its generated features to make a solely automated employment, eligibility, credit or other decision about you with legal or similarly significant effect on behalf of CareerCaptain.

When CareerCaptain reads a file or photo, the information it picks up is used to help you search and use that item later. It does not replace the original as the authoritative source. If you choose to remove the original after CareerCaptain has read it, you are responsible for keeping any separate copy you may need later.

CareerCaptain does not provide legal, financial, medical, employment-law or other regulated professional advice. Important decisions should be checked against authoritative information or an appropriately qualified adviser where necessary.

6. Acceptable use

You must not use CareerCaptain to:

  • break the law or infringe another person's rights;
  • upload malicious code or deliberately interfere with the service;
  • attempt to get into another account, area or information you are not authorised to access;
  • scrape, probe or reverse engineer the service except where the law expressly permits it;
  • use the service to harass, discriminate against or unlawfully monitor another person.

7. Availability, changes and suspension

We aim to keep CareerCaptain available and reliable, but no online service can be guaranteed to be uninterrupted. We may temporarily restrict access for maintenance, security, legal compliance or to prevent misuse. Where practicable, we will avoid unnecessary disruption.

8. Paid features

CareerCaptain offers Free, Pro and Executive plans. Current prices, monthly limits and billing intervals are shown on the Pricing page and again before you confirm a paid subscription in Stripe Checkout. Paid subscriptions renew automatically for the selected monthly or annual period until cancelled.

You can schedule cancellation at the end of the current paid period. Access to paid features continues until that period ends unless Stripe or applicable law requires otherwise. Cancelling a paid subscription does not itself delete your CareerCaptain account or career information, and downloading your information remains available on Free.

Paid plans include stated monthly limits for generated features. Reaching a limit does not trigger an automatic extra charge: that feature is limited until the next usage period or until you change plan. We may change future prices or plan contents, but changes affecting an existing paid subscription will be communicated and applied consistently with the contract and applicable consumer law.

Payments are processed by Stripe. CareerCaptain's current checkout does not add a separate mandatory platform or service fee to the subscription price displayed on the Pricing page. If a legally required tax or mandatory charge changes what a consumer must pay, the total-price presentation will be updated before the consumer is asked to commit. Statutory cancellation, refund and other consumer rights remain unaffected; where the law permits those rights to be affected by a request for immediate digital service, the relevant information will be provided at the point of purchase.

Before a first paid subscription opens, CareerCaptain asks you expressly to request immediate performance. That request is recorded with the checkout. It does not remove any statutory right that the law says must remain available.

9. Intellectual property

CareerCaptain, Fat Genie branding, software, product design and service content are owned by or licensed to The Better Growth Company Ltd except for user content and third-party materials. These terms do not transfer ownership of the career information you add to us.

9A. Institution-sponsored Campus access

An eligible university, students' union, college or other organisation may pay for a level of CareerCaptain access for you through CareerCaptain Campus. This is linked to an active Campus membership; it is not a personal Stripe subscription and may change or end if the institutional membership, number of available places or commercial arrangement ends.

Ending sponsored access does not by itself transfer ownership of, or give the sponsoring organisation access to, your CareerCaptain information. Unless a separate feature explicitly asks you to share selected information, Campus membership alone does not authorise institutional staff to inspect your individual career information, files, questions or generated work.

Campus reporting is intended to describe overall service use and outcomes learners explicitly report themselves. It is not intended to create an individual employability score or prove that CareerCaptain caused an employment, academic or career outcome.

10. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or rights that apply to consumers by law.

Subject to those protections, CareerCaptain is a decision-support and record-keeping product rather than a guarantee of any career, employment, commercial or financial outcome.

11. Ending use of CareerCaptain

You may stop using the service at any time. We may suspend or terminate access where reasonably necessary for serious breach, security risk, unlawful use or where the service is withdrawn, subject to applicable consumer and data-protection law.

12. Governing law

These terms are governed by the law of England and Wales. If you are a consumer, you may also benefit from mandatory protections and rights to bring proceedings in the part of the United Kingdom or other jurisdiction where you live where applicable law provides them.

13. Complaints

If something has gone wrong, contact Fat Genie and tell us what happened and the outcome you are seeking. If a consumer complaint reaches deadlock, we will provide any alternative-dispute-resolution information the law requires at that time.
